These terms and conditions govern your use of our website. Please read these terms in full before you use this website. If you do not accept these terms and conditions, please do not use this website. Your continued use of this website confirms your acceptance of these terms.

Website access

It is not necessary to register with us in order to use most parts of this website. However, particular areas of this website will only be accessible only if you have registered.

Use of website

This website may be used for your own private purposes and in accordance with these terms and conditions.

You may print and download material from this website provided that you do not modify or reproduce any content without our prior written consent.

Website uptime

All reasonable measures are taken by us to ensure that this website is operational all day, every day. However, occasionally technical issues may result in some downtime and accordingly we will not be liable if this website is unavailable at any time.

Where possible we always try to give advance warning of maintenance issues that may result in website down time but we shall not be obliged to provide such notice.

Visitor provided material

Any material that a visitor to this website sends or posts to this website shall be considered non-proprietary and non confidential. We shall be entitled to copy, disclose, distribute or use for such other purpose as we deem appropriate all material provided to us, with the exception of personal information, the use of which is covered under our Privacy Policy.

When using this website you shall not post or send to or from this website any material:

(a) for which you have not obtained all necessary consents;

You agree that, to the fullest extent permitted by applicable law, Prism Polish UK will not be responsible or liable (whether in contact, tort or otherwise), under any circumstances for any events beyond our reasonable control.  Further, to the fullest extent permitted by law, we will not be liable for any direct, indirect, special, incidental, or consequential damages of any kind (including lost profits) related to the site regardless of the form of action whether in contract, tort (including negligence) or otherwise, even if we have been advised of the possibility of such damages.  In no event shall our maximum aggregate liability exceed one hundred sterling as applicable or the value of the goods ordered, whichever is greater.  Our liability is limited to the maximum extent permitted by applicable law. 

Shipping

Your order will be processed and delivered without undue delay, no later than 30 days after your order has been placed.

When your order has been dispatched, you will receive an email to let you know - please allow up to 10 working days from this email for delivery. If your order has not arrived in this time, please wait no longer than 18 calendar days from your order dispatched email to contact us and let us know. After this point, we are unable to track your order with Royal Mail to resolve your delivery issue and no refunds will be issued on delivery queries. 

If you wait longer than 18 calendar days to inform us that your order has not arrived and your parcel is returned to us, we will automatically refund your order using the original payment method (less payment processing fees and postage and packing costs). You are welcome to re-purchase your order if this happens. 

All orders are subject to availability.

Cancellations, returns and refunds

All customers have the right to cancel their order under the Consumer Contracts (Information, Cancellation & Additional Charges) Regulations.

Your right to cancel an order for goods starts the moment you place your order and ends 14 days from the day you receive your goods.

To meet the cancellation deadline, please notify us via email or the 'Contact Us' form on the website about cancelling the order before the cancellation period has expired.

Please note that where you have paid via PayPal and cancelled an order, the PayPal fee for placing the order will be deducted from your refund.

If you are in possession of the goods you are under the duty to retain them and take reasonable care of them. You must send the goods back to us to our contact address at your own cost (unless we delivered the item to you in error or the item is damaged or defective) as soon as possible once you have cancelled the order.

We reserve the right to make a charge not exceeding our direct costs of recovering the goods if you do not return the goods or return them at our expense.

Once you have notified us that you wish to cancel the order, any sum debited to us will be refunded to you as soon as possible and in any event within 14 days of your cancellation.

You will not have any right to cancel an order for the supply of goods that are made to the customer's specification or are clearly personalised, or are clearly marked as a prototype.  

In addition you will lose your right to cancel if you:

(a) open goods that are not suitable for return if they are opened, due to health protection or hygiene reasons.

(b) combine goods with other goods after delivery so that they become inseparable.

Please note that no refunds or exchanges will be given on prototypes.  No refunds will be given on mystery polishes, although store credit notes can be issued.

Combining orders

We will aim to combine shipping of orders where possible, but please bear in mind that we are extremely busy during new product launch periods. To ensure combined shipping occurs, please in the first instance please use the 'contact us' form on the website or email hello@prismpolish.co.uk quoting your order numbers to be combined.  If you leave it as a note on the order, we cannot guarantee it will be read due to our order processing procedure. Please note that where you have paid via PayPal, your postage refund for combining orders will have the PayPal fee deducted from it.


Faulty / damaged goods

If your goods arrive damaged, please contact us within 14 calendar days to request your replacement items.  Please note that replacement products are subject to availability and it is not always possible for us to replace your products like-for-like.  Should your goods arrive damaged, please email us in the first instance at: hello@prismpolish.co.uk or using the contact form on our website with pictures of your damaged parcel and items, as well as a list of your damaged products.

For faulty goods, please contact us within 3 months of purchase.  Unfortunately requests received beyond 3 months after purchase will not be eligible for a full refund.  Please email us in the first instance at: hello@prismpolish.co.uk with pictures showing the fault/issues with your products, list of affected products, and how you would like us to resolve it (exchange, where applicable, or refund).  Please note that without photographs of the issue, we are unable to provide you with a full refund.

Incorrect address

The buyer is responsible for entering and checking the correct delivery address has been chosen when receiving their order confirmation email. If an incorrect delivery address is entered and we are not contacted before dispatch, the buyer will be held responsible for any additional expense in re-delivery to the correct address.

Please note that when paying via PayPal, PayPal often overrides any delivery address entered to your default delivery address held on file with PayPal. If this happens, please contact us ASAP either using our contact form or emailing hello@prismpolish.co.uk

Care of thermal polishes

Some thermal pigments may clump slightly post-manufacture, which will appear as small blobs on your nail as you paint them. Ensure you give your thermal polishes a good shake before use and if you do notice a small blob, just remove it and continue with your manicure. Leaving the blob will result in the darker thermal colour showing through the warm colour.

**Please note that thermal polishes have an average transitioning life of 9 - 12 months and after this period may require exposure to more extreme temperatures to change colour and then may stop transitioning at all.  This is perfectly normal and your polish will still be perfectly safe to use. But we do recommend that you keep your thermal polish in a cool, dark place to help preserve it's shelf life!**

If temperatures hit 29oC and above, protect your thermal polishes by not using them and storing them in a fridge no lower than 5oC. Prolonged exposure to high temperatures will 'burn' a thermal so that it will not transition any more. No refunds will be given on thermal polishes 'burned' from high temperatures.​

Gift vouchers

Any gift vouchers/promotional codes must be applied at checkout, entered after clicking 'I have a gift voucher or promo code' (as directed on the gift voucher). No gift vouchers or promotional codes can be applied retroactively as refunds. If you have any issues with your gift voucher or promotional code, please contact us via email hello@prismpolish.co.uk BEFORE placing your order.

Law and jurisdiction

These terms and conditions are governed by English law. Any dispute arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the Courts of England and Wales.

You have a statutory right of a 14 day cancellation period after you receive your polish so that you can decide whether to keep them or not.  This is subject to my receipt of a cancellation request before the 14th day after receiving your polish – if you don’t receive confirmation, it will still be valid as long as it’s 14 days or less after receiving your polish.  Only unopened, unused polish is eligible for a cancellation request due to health and hygiene reasons. 

Please contact me via email, the contact form on my website if you wish to return your polish and require a full refund.  Please keep in mind that you will be responsible for the return postage and if you have paid via PayPal, the PayPal fee will be deducted from your refund amount.

PayPal Pay in 3

PayPal Pay in 3 is a payment method where you can buy now and pay in 3 instalments, the first of which will be due at the time of purchase. The following 2 instalments will be payable monthly on the same date.

To pay with PayPal Pay in 3 you must be over 18 and live in the UK (excluding Channel Islands and Isle of Man), and you'll need to spend £45 or more. Your credit will be checked by PayPal before your order is confirmed, so your application to use PayPal Pay in 3 may be rejected.

PayPal Pay in 3 is designed to give you extra flexibility when paying by spreading the cost through instalments,  but please remember to spend responsibly.

How does it work? At checkout, you'll have the option to pay via PayPal Pay in 3, you'll be directed to your PayPal account as usual where you'll see PayPal Pay in 3 as one of the available payment methods. When you select this method, you can apply for PayPal Pay in 3 in a few simple steps, get an instant decision and complete check out. Your order will be divided into 3 equal instalments, with the first instalment due at the time of purchase. The remaining 2 instalments will need to be paid directly into your PayPal account on the same date the following 2 months. PayPal will send you a reminder by email or text to let you know when your next payment is due. You can see details of how much you owe at any time by logging into your PayPal account. There are no fees to use PayPal Pay in 3, but if your payment is late, you'll be charged a £12 late fee if payment is not made within 3 days.
